Platform Terms & Conditions

1. Acceptance

By creating an account on or otherwise accessing the Earthscan AI 360° Platform (the "Platform"), you agree to these Platform Terms & Conditions on behalf of yourself and the organisation you represent. If you do not agree, do not access the Platform.

2. The Platform

The Platform provides a secured, per-organisation workspace for subsurface-AI projects, deliverables and collaboration operated by Earthscan.io B.V. Access is granted to authorised users of a contracting organisation and is scoped to that organisation alone.

3. Accounts & access

You must register with your corporate email and keep your credentials confidential. New accounts are created in a pending state and obtain access to a workspace only after an Earthscan administrator grants it. You are responsible for activity under your account and must notify us promptly of any unauthorised use.

4. Security & two-factor authentication

Two-factor authentication is required for Platform access and is configured on first sign-in. You agree not to share authentication factors, circumvent access controls, or attempt to access data belonging to any organisation other than your own.

5. Acceptable use

You will use the Platform only for lawful business purposes, will not probe, scan or test the vulnerability of the Platform without written authorisation, will not upload malicious code, and will not interfere with other users or the integrity of the service.

6. Tenant data & confidentiality

Each organisation’s data is isolated from every other organisation. Earthscan treats the content you submit as confidential and processes it to provide the Platform and the services you have contracted for. Data handling is further governed by the agreement between Earthscan and your organisation and by our Privacy Policy.

7. Intellectual property

The Platform, its software, models, designs and brand are owned by Earthscan.io B.V. and its licensors. You retain ownership of the data and materials you upload. No rights are granted to you other than the limited right to use the Platform as set out here.

8. Availability & changes

We aim for high availability but the Platform is provided on an "as available" basis and may be updated, suspended for maintenance, or modified. We may update these terms; material changes will be notified, and continued use after an update constitutes acceptance.

9. Warranties & liability

To the maximum extent permitted by law, the Platform is provided without warranties of any kind, and Earthscan’s aggregate liability arising from your use of the Platform is limited as set out in the agreement between Earthscan and your organisation.

10. Termination

We may suspend or terminate access that violates these terms or where the underlying agreement with your organisation ends. You may stop using the Platform at any time.

11. Governing law

These terms are governed by the laws of the Netherlands, and the competent courts of the Netherlands have exclusive jurisdiction over any dispute, without prejudice to any mandatory consumer protections.
